Selling handmade knitwear and custom knitwear, knitting patterns, (online) workshops.

 

3.        Terms and Conditions

The terms and conditions that the customer agrees to when purchasing:   

ART. 1  OFFER

The offer on the webshop is kept up to date as much as possible and described with the correct information, but Apella Knits is not responsible for any errors in stock and color representations on the screen. Apella Knits has the right to cancel orders and purchases when stocks do not permit. In this case, a refund or exchange will be arranged with the consumer.

 

The offer is valid while stocks last and can be adjusted or withdrawn by Apella Knits at any time. Apella Knits cannot be held liable for the unavailability of a product.

  • Finished Products

These products are made by hand on the knitting machine in the Apella Knits workshop. These products are made with quality yarn. Due to the manual work, small imperfections can always occur. Apella Knits nevertheless tries to manufacture and finish all products as carefully as possible.

  • Digital files

When purchasing knitting patterns, the consumer will receive digital files (unless otherwise stated). After payment, the consumer will receive a link to the files by email. This link is active for 30 days. The digital files must be downloaded by the customer within this period.

  • Pre-orders

Orders for pre-orders will be processed within the time frame stated. Payment is made together with order. The customer has the right to cancel the order and request a refund for 14 days.

  • Custom orders/repairs

For custom orders, a margin is given between which the final total price will be located. To confirm the order, the consumer pays an advance of 20%. When the finished product is delivered, a final order form is drawn up and the advance is taken into account of the final total price. The customer has the right to request one round of adjustment. Shipping costs are for the customer.

ART. 2  INTELLECTUAL OWNERSHIP

All intellectual property rights to materials developed by Apella Knits are held exclusively by Apella Knits and are protected by intellectual property rights.

The consumer exclusively acquires the rights of use and powers that are granted in these general terms and conditions. The consumer will not reproduce, publish or use these materials for their own commercial purposes. Products that are offered on the basis of the knitting patterns and workshops offered may not be used commercially without Apella Knits' permission.

ART. 3  PRICES AND PAYMENTS

The prices on the website are stated in euros, including VAT and excluding shipping costs.  Any additional costs are the responsibility of the consumer.

Apella Knits reserves the right to change the prices of goods at any time.

 

After your order you will receive a confirmation email with an overview of your order and the total amount, including shipping costs.

 

An order is only complete when payment has been made. Payment is made in a secure environment via bancontact, mastercard or paypal.If these payment options are not within the options of the consumer, payment can also be made by bank transfer. Please contact apella.knits@gmail.com for this

ART. 4  RIGHT OF WITHDRAWAL

In the context of distance sales to consumers who fall within the scope of the law, the consumer has the right to inform the seller that he renounces the purchase, without payment of a fine and without giving any reason within 14 calendar days. from the day following delivery. The product is in perfect and unworn condition.  If the consumer invokes this option, he must return the goods at his own risk and expense to Apella Knits Constant Verhulststraat 55 2590 Berlaar.

 

ART. 5.     LEGAL WARRANTY

 

Apella Knits undertakes to deliver products in good condition. If this is not the case, the customer is entitled to a repair, replacement or refund. In addition, when purchasing finished products, the customer receives a free repair service that is valid for up to 1 year after purchase for repairs or accidental damage. The goods are shipped at the consumer's own risk and expense  sent back.

 

ART. 6  EXCHANGE AND RETURNS

  • Products purchased through the webshop can be exchanged within 14 calendar days from the day following delivery. These can then be exchanged for another product or the purchase can be refunded. Shipping costs already paid will not be refunded. Returned products must be in perfect and unworn condition.

  • The consumer who upon receipt to inspect the delivered goods. If there is a suspicion of imperfections or if the goods do not conform to the agreement, the consumer should immediately contact Apella Knits. If the damage is due to a manufacturing defect, a refund, exchange or repair will be proposed.

In both cases we ask you to contact us as soon as possible by mail, this can be done at apella.knits@gmail.com We do not accept returns or repairs without prior communication by mail.

 

If there is a difference in price between the exchanged and new product, that difference will be charged, either by payment by the consumer or by reimbursement by Apella Knits. Both the shipping costs for returning and any new costs when returning repairs or exchanges are for the account of the consumer.

 

A product must be returned in proper packaging. This means that the product is packed in such a way that further damage to the knitwear is prevented. An item shipped loose in a box will not be accepted as a valid return.  

 

Apella Knits reserves the right to refuse returns if it suspects that the items have already been used or if damage is suspected to be caused by a fault other than the seller or the supplier of the item.

 

Exchange and return from a point of sale: When you have purchased a product in one of our points of sale, you must arrange all further follow-up via that same point of sale. Repairs are also accepted up to 1 year after purchase of the product.  

 

Custom orders and repairs cannot be returned.

ART. 7  SHIPPING AND DELIVERY

Shipping can be done in 3 ways:

  • Collection in the studio in Berlaar by appointment

  • Delivery via BPost in Belgium (€ 5.70)

  • Delivery via BPost at a collection point (€4.70)

Packages are only delivered in Belgium. Would you like to place an order from another country? Please contact us at apella.knits@gmail.com

 

Products in stock are shipped on Wednesdays and Saturdays. The delivery time is from then 2 to 3 working days. However, Apella Knits is not liable for any delays.

Apella Knits is not liable for loss, damage or theft during shipment.

 

Products ordered via pre-order will be shipped according to the delivery period stated on the website. If this period is delayed by more than 14 days, Apella Knits will contact the consumer. The consumer then has the right to cancel the order and request a refund, as long as the product has not yet been sent to the consumer.

 

Customized products and repairs are delivered according to the agreed delivery time.

The buyer's personal data is processed in accordance with the law of December 8, 1992 on the protection of privacy with regard to the processing of personal data.
